Division V. ENFORCEMENT

For the purpose of ascertaining compliance with the provisions of Subchapter I of Chapter 295, Wisconsin Statutes, Chapter NR 135, Wisconsin Administrative Code, or this chapter, any authorized officer, agent, employee or representative of Kenosha County Department of Planning and Development may inspect any non-metallic mining site subject to this chapter as provided below:

(1) No person may refuse entry or access onto a non-metallic mining site of a duly authorized officer, employee or agent of Kenosha County Department of Planning and Development or the Wisconsin Department of Natural Resources who presents appropriate credentials to inspect the site for compliance with the non-metallic mining reclamation permit, this chapter, Chapter NR 135, Wisconsin Administrative Code or subchapter I of ch. 295, Stats.

(2) Any person who enters the site under this right of inspection shall obtain training and provide their own safety equipment needed to comply with any federal, state or local laws or regulations controlling persons on the non-metallic mining site. [Code § 13.05-1.]
